Standard
Terms and Conditions of Trading
By ordering from us you acknowledge your responsibility
to abide by our standard procedures and terms and conditions of
trading under which all orders are placed.
Language offered for conclusion of the contract of the sale
The language offered for conclusion of the contract of the sale
is English.
No Minimum Order Value
We despatch all orders no matter how small and have no minimum order
value requirement.
Carriage and Handling - (see here)
- what is this charge for? All orders generate a substantial
amount of paperwork and record-keeping activity. They require forms
and labels to be printed and packaging and other materials to be
used. Your order details have to be checked and your order addressed,
invoiced and picked. The contents must then be checked, re-checked,
packaged, labelled and finally sent for despatch. All of these activities
take a substantial amount of time whether your order is small or
large and we have to cover the costs of the time taken to process
your order and of the materials used along with the actual postage
costs.
Security
and fraud prevention:
We use the
PayPal internet payment processing system to handle our customers
payments. PayPal maintain a formidable security system to protect customers
from unauthorised use of their credit and debit cards.
Unlike most other Internet payment processing systems, PayPal never
pass on your credit card details to the merchant - we do not see any
details of the card that you use to make your purchases.
Most credit card fraud arises where card details have been copied by
staff in shops and restaurants who then use the card details to make
fraudulent purchases.
Technical
advice - Use our 'CONTACT
US' page or write to us -please remember to enclose a SAE with
all letters.
Prices - All prices are in Pounds Sterling (GBP -
Great Britain Pounds). The prices charged will be those that are current
on the day that you place your order.
Title - Goods remain the property of Remtrak until
payment has been received in full.
Payment - If you send payment in cash then the currency
must be £ GBP Sterling. Where cash is sent to us in the post
it must be sent by Special Delivery or other courier service and must
carry sufficient insurance for the sum enclosed - we cannot accept
responsibility for cash that is lost in the post.
By cheque drawn on a UK bank / postal order in pounds sterling (£
GBP) only, made payable to REMTRAK
By PayPal in pounds Sterling.
VAT - We are not VAT registered and the prices which
are shown are the full product prices excluding the appropriate carriage
and handling charge - details of our carriage charges can be found
in the first group of items on the menu at the top left of every web
page under "CARRIAGE", and by clicking here - CARRIAGE
Despatch - Although most orders are despatched within
24 hours, we are unable to guarantee delivery times as these depend
upon the performance of the courier. Please remember that Royal Mail's
required time to allow for transit is fifteen working days.
Where products which are manufactured to order, or ordered specially
for you, please remember to allow extra time for your order to arrive.
All international orders (despatched to destinations outside
the UK) are sent by Air Mail, Royal Mail signed for International
and will require a signature on receipt.
We do not despatch international orders by surface mail.
Orders - All orders for goods shall be deemed to be an offer
by the buyer to purchase goods pursuant to these terms and conditions
and are subject to our acceptance.
We may choose not to accept an order for any reason.
Special orders - We hope that
you are satisfied with the goods that you order. We take care to ensure
that the goods are accurately and adequately described in our literature
and on our Website. However, since items which are not standard stock
items which we order, manufacture or modify for you cannot be returned
for a refund (as they have no resale value), if you have any doubts
at all about the quality or suitability of a special order item, we
advise that you do not place the order without contacting us via
our web form prior to ordering. We cannot accept the return of
any item that we have to order, manufacture or modify especially for
you. You must use our contact form
to advise of any modification that is required and seek our agreement
prior to ordering.
Returns private consumers only - goods incorrectly
ordered or not wanted within the UK
You must contact us to request a returns number which you must
write clearly on the outside of your package. For reasons of fraud
prevention we do not take delivery of any package not carrying our
valid reference number. Goods must be returned within 7 days. The
law requires you to preserve products that you intend to return in
the state that you received them. They must be unused with the
original packaging completely intact and undamaged. This particularly
applies to any product's sealed plastic bag, heat or vacuum sealed
plastic packaging and all shrink-wrap packaging. If the item has been
damaged, used or is not returned with its original packaging completely
intact and undamaged it will not be accepted for return. Where the
physical appearance of the product affects it’s saleability,
most notably in the case of, but not confined to, wristwatches and
clocks, items which are scratched or otherwise marked will not be
accepted for return. The judgement as to the saleability of an item
is exclusively the decision of Remtrak. You are required by EU law
to contact us in writing or by e-mail using our 'contact
us' web form to let us know that you wish to return the goods
that you have ordered; you must quote the invoice number and ask for
a returns number. For reasons of fraud prevention we will not accept
delivery of any package that does not carry our valid returns number.
You will be liable for the cost of returning the goods to us. We will
not accept any liability for items ‘lost in transit’.
Returns will only be accepted if our valid returns number is clearly
written on the outside of your package. If your return cannot be accepted,
you will be liable for the cost of returning your goods to you. We
cannot accept the return of any item that we have to order especially
for you.
Returns - all business customers and customers
outside the UK - goods incorrectly ordered or not wanted may be accepted
for return strictly at our discretion. They must be returned
within seven days and you must contact us first to enquire. A 30%
handling charge will apply with a minimum charge of £8.50.
Goods which we order specially for you may be subject to higher restocking
charges. The law requires you to preserve products that you intend
to return in the state that you received them. They must be unused
with the original packaging completely intact and undamaged. This
particularly applies to any product's sealed plastic bag, heat or

Cancellation - You may request a cancellation of your order
providing that the order has not already been sent for packing and
despatch and that no arrangement has been made or courier service
booked for the order's despatch and delivery to you. You may not cancel
any order containing goods we have to order especially for you. You
must notify us in writing of your wish to cancel any order. A telephone
call is not sufficient.
Batteries - Where a product is supplied complete with batteries,
the batteries are included free of charge for demonstration purposes
only, do not comprise any part of the cost of the product and are
not included in any part of the manufacturer's guarantee.
Guarantee - Products are guaranteed against manufacturing
faults for twenty eight days from the date of purchase, thereafter
the manufacturer's warranty shall apply. Warranties and guarantees
are non-transferable. Always take care to retain your invoice number
as this is your guarantee reference. Guarantees cover manufacturing
faults only, do not cover misuse and specifically exclude accidental
damage. Batteries and, where applicable, watch and clock faces, watch
straps, chains and bracelets are not covered by the guarantee. Products
are thoroughly examined and tested before stocking to ensure that
they are undamaged, saleable and in good working order. Most problems
are due to incorrect use or wiring on the part of the customer. If
you believe that your item has a fault you must first consult the
operating instructions to ensure that you are using the product correctly.
In the case of battery operated items, it frequently happens that
the customer inserts batteries without due regard for their correct
orientation. Always test battery operated products with NEW,
good quality batteries, take great care to ensure that you have inserted
the batteries correctly in their holder and that you are operating
the equipment in accordance with the manufacturer's instructions.
Radio reception varies depending upon location and the circumstances
in the place where the radio is operated. Electronic and electrical
equipment, walls and large metal object may affect radio reception.
This (as is common knowledge) particularly applies to FM radio signals.
If you are having difficulty receiving radio signals, you should re-orient
the receiver.
If you believe that an item has developed a fault within 28 days of
receipt, as covered under the guarantee, contact us and ask for
technical advice. Please enclose a SAE with all written communication.
You must contact us in writing or by e-mail using our 'contact
us' web form to let us know that you wish to return goods under
guarantee, you must quote your invoice number, which is your guarantee
reference, and ask for a returns number. We will then advise as
to the return carriage costs that you must include with the item.
For reasons of fraud prevention we will not accept delivery of any
package that does not carry our valid returns number. We will not
accept any liability for items returned to us which are ‘lost
in transit’. Returns under guarantee will only be accepted if
our valid returns number is clearly written on the outside. If our
returns department cannot accept your return you will be liable for
the cost of returning your goods to you. Faulty goods returned under
guarantee will be repaired or replaced. For reasons
of fraud prevention, we will not accept cancellation of any order
on these grounds. For reasons of fraud prevention we will not accept
cancellation of any order on the grounds of an allegation of damage
in transit. If, upon testing, we find that the returned item is not
at fault, you will be liable for the cost of the return carriage to
you, therefore always contact us and ask for technical advice
before requesting a returns authorisation number from us and returning
goods which you suspect to have a fault. Where items are returned
to us under guarantee within seven days of receipt and where the item,
upon our inspection is found to be at fault as covered under the terms
of the guarantee, we will refund return carriage costs at the minimum
rate applicable. "Carriage costs" refers to the packed weight of the
item as it is when we despatch it.

us' web form upon receipt of the goods for your claim to be considered.

without having obtained our valid authorisation returns number in
advance will not have their carriage costs refunded. Where goods are
returned, claimed as sent in error accompanied by a request to cancel
the order, return carriage costs will not be refunded.
Defective goods - All products, without exception, are examined
prior to packaging to ensure that they are saleable, undamaged and
in good working order.
If you believe that you have received an faulty item you must first
consult the operating instructions to ensure that you are using the
product correctly. In the case of battery operated items, it frequently

instance, ask for Technical Advice.
If, following your communications with our technical staff and their
technical advice to you, it appears that there may be a problem with
the product, you must ask for a returns number to be 'attached' to
your invoice and we will issue you with a returns number so that you
may return the goods to us for inspection. The returns number must
be clearly marked on the outside of your package. For reasons of fraud
prevention we will not accept delivery of any package that does not
carry our valid returns number.
You will be advised of the return postage costs to be included with
the item when you send it to us. Please note that if this payment
is not included with your item you will have breached your contractual
agreement with us and any returned item will not be processed BUT
SHALL CONSTITUTE UNSOLICITED GOODS.
Where an item is returned to us for testing within seven days of receipt
and where, upon testing it, we find it to be at fault under its terms
of guarantee, we will subsequently repair or replace the item, refund
your enclosed return carriage costs payment, refund your return carriage
costs and cover all postage costs ourselves at the standard minimum
rate.
Items which have been damaged by the customer will be repaired or
replaced at the customer's cost.
Note: It is our policy to actively pursue all instances of fraud
and attempted fraud through the Courts; it is our policy in the event
of attempted fraud and / or extortion, to lay formal complaints with
the Police.
Unsolicited Goods - Items sent to us in contravention of our
standard terms and conditions and items sent to us without our prior
and express consent shall constitute unsolicited goods.
Descriptions: All product images, descriptions and
specifications are non-contractual and supplied in good faith whether
they originate with us or with our suppliers.
Shades and tints of colour may be subject to variation as they depend
upon many factors including the settings of the viewer's monitor.
If the exact colour of an item is important you must contact us for
further information prior to ordering.
Where technical goods are ordered but unavailable at the time that
the order is received we reserve the right to supply a substitute
where the substitute will serve as a suitable replacement for the
item ordered.
Leads, cables, connectors, plugs, sockets and adapters are exclusively
supplied for use with test equipment and are items to be used for
test purposes only.
In keeping with our policy of continually refining
and upgrading products, we reserve the right to amend descriptions
and specifications without notice.
Fees - The cost of preparation of initial documentation including
invoicing and customs documentation and declarations is included in
the carriage and handling costs.
In most instances, but always at our discretion, we waive the cost
of issuing and processing our own claims forms for 'non-receipt' and
'damage in transit'.
For issuing a duplicate invoice where the invoice number is known,
the fee is £5.00
For issuing a duplicate invoice where the invoice number is not known,
necessitating a manual search of our records, the fee is £25.00
In all instances where we are caused to spend time in the composition
of technical and / or legal reports, compositions and responses, the
fee is calculated at the rate of £1.00 per minute. Where necessary,
we recover fees through the Civil Courts.
Liability: - We shall not be liable for incidental
or consequential damages, including but not limited to costs of removal
and re-installation of Goods, loss of goodwill, loss of profits or
loss of use etc.
We shall not be liable to
You for any delay or failure to perform any of our obligations hereunder
which is due to causes or circumstances beyond our reasonable control,
including (without limitation) acts of civil or military authority,
national emergencies, fire or flood, acts of God, war or riots, actions
or omissions of third parties.
You agree
to indemnify us against all costs arising from any dispute, legal
or otherwise, including all disputes between yourself and us and all
disputes, legal or otherwise involving any and all third parties.
Nothing in these terms and conditions affects your statutory rights.
In ordering from
us you accept that:
This agreement is the complete and exclusive statement
of the contractual relationship between the parties, which supersedes
all prior proposals, understandings, agreements, or representations
between the parties and replaces any and all terms and conditions
of the purchaser.
